Whilst we prioritize the sending of notifications/emails to Premium users, we will not be liable if notifications do not ultimately arrive faster than notifications for non-Premium users. We rely on third parties to send notifications/emails to you (e.g. Apple, Google) who have their own proprietary notification algorithms.

By using HotStock, or buying products and/or services from third party advertisers and/or affiliates linked within HotStock, you agree to hold harmless HotStock, its owners, its staff, its advertisers, its affiliates, its interviewees, and its content providers from any claims, actions, or demands, including and without limitation reasonable legal and accounting fees, made by any third party due to or resulting from your use of the information, products, and/or services provided through HotStock. While we do our best to only recommend high quality products with great customer service, we are not responsible for any products ordered through our links or from our affiliated merchants. If you have a problem with an item or service you purchased from one of our affiliated merchants, you will need to contact them to resolve the problem. We are not to be held accountable for any actions or lack of actions from our linked/affiliated merchants. User generated content and comments

All user generated content on this site, including - but not limited to - comments, your HotStock username, is subject to review, modification, or deletion by administrators. However it is not feasible for administrators to read every post. Furthermore any views or opinions presented are solely those of the author and do not necessarily represent the views of HotStock. Please review our Comment Policy to ensure compliance. Additionally, we reserve the right to suspend or delete user accounts, ability to comment, user's Premium status, and products from our catalog.

The user shall not upload, post or otherwise make available on HotStock any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the user. The user shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of HotStock, the user automatically grants, or warrants that the owner of such material has expressly granted HotStock the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material.

The user also permits any other user to access, view, store or reproduce the material for that user's personal use. The user hereby grants HotStock the right to edit, copy, publish and distribute any material made available on HotStock by the user.

Intellectual Property

All rights in HotStock and its features remain our property. You receive only a limited license to use the service according to these terms.

Governing Law and Regional Variations

These Terms shall be governed by and construed in accordance with the laws of England and Wales, unless otherwise required by local law.

United States Residents: Disputes are subject to binding arbitration and waiver of class actions, as detailed below in the Dispute Resolution section.

Canadian Residents: If you reside in Canada, these Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless otherwise required by applicable provincial law. You agree to resolve any disputes arising from your use of HotStock through individual arbitration, to the extent permitted by applicable law. Nothing in these Terms limits your rights under provincial consumer protection legislation.

Dispute Resolution and Arbitration (U.S. and Canadian Users)

If you are a resident of the United States or Canada, you agree that any dispute, claim, or controversy arising out of or relating to your use of HotStock, these Terms, or your relationship with LiteBox Ltd shall be resolved through final and binding arbitration on an individual basis.

This applies to all disputes including those based in contract, tort, statute, fraud, or misrepresentation, and survives termination of these Terms.

The arbitration shall be administered by the American Arbitration Association (AAA) or, for Canadian users, another mutually agreed-upon arbitrator or forum. Arbitration may be conducted virtually.

Class Action Waiver: You and LiteBox Ltd agree that disputes may only be brought in an individual capacity, not as a class member or representative. You waive any right to participate in a class or representative proceeding.

Exceptions: You may still file a claim in small claims court, or if applicable law prohibits arbitration (e.g., certain provincial laws in Canada), this section will not apply to the extent of that prohibition.

Opt-Out Option: You may opt out of this arbitration agreement by sending written notice to us via our Contact Form within 30 days of your first acceptance of these Terms. Your opt-out notice must include your full name and clearly indicate your intent to opt out of arbitration. Opting out of arbitration will not affect any other provisions of these Terms.

Dispute Resolution and Arbitration (UK and International Users)

If you are not a resident of the United States or Canada, any disputes or claims arising out of or relating to these Terms, or HotStock will be governed by the laws of England and Wales. You agree that such disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by local law.

Children

HotStock is not intended for children under the age of 13 in the United States, or under the age of 16 in other jurisdictions, including Canada. We do not knowingly collect personal information from anyone under these ages. If we become aware that we have inadvertently collected personal information from a child, we will promptly delete the data and take steps to prevent further collection.
